Voting Rules

1. HOW TO VOTE

To support your favourite project, you can vote on the individual project submission pages. You will be allowed to vote once per week per project and e-mail address. You are free to support as many projects as you want (always with one vote only).

The number of votes received per project will not be disclosed during the voting period. The votes that are submitted are being verified and collected during the entire voting period. The votes submitted during each week’s voting phase will be collected and summed up for a final total of valid votes submitted for each project to determine the winners of the online voting.

Your email contact will not be used or filed for any other purpose than the public online voting. Any records of email addresses used for the online voting will be deleted once the voting process concluded.

The details requested during the voting process will be solely used for administration of the Awards. The data used for administration of the Awards are subject to Walk21 Vienna 2015 privacy policy and the Data Protection Act 2000 (Federal Law Gazette I 195/1999 as amended by Federal Law Gazette I 51/2012).

The voting procedure on these individual submission pages is the following:

Have a look at your mailbox, find the confirmation email sent to you with the subject line „Walking Visionaries Awards – Confirm your vote!“. Click on the link included in this e-mail to activate your vote. Your vote will only be counted if this link was activated!

2. VOTING PERIOD

Voting will commence on 26 May 2015, at 2 PM CET and shall continue throughout 16 June 2015, at 1 PM CET. The Voting Period is subject to change at Walk21 Vienna’s sole discretion. The winners in each category will be announced within a week of completion of the voting procedure.

3. PRIZES (“Walking Visionaries”)

Winners of the Walking Visionaries Awards are entitled to free participation in the Walk21 Vienna conference, held in Vienna, Austria in October 2015. Free participation in the conference equals a full conference ticket valid for the Walk21 Vienna conference in Vienna, Austria. The prizes exclude any reimbursement of travel costs or financial aids of any other sort.

There are 30 prizes available, which will be allocated amongst the Award contestants (submitters to the “ Walking Visionaries Awards”) 15 prizes will be allocated by the online voting and 15 prizes will be allocated by the jury vote. The detailed number of tickets allocated per category in the online voting will be published after expiry of the submission deadline.

ONLINE VOTING PRIZES
The 15 prizes awarded in the online voting will be distributed as follows:

4 prizes – Advocacy, Campaigning and Social Projects
2 prizes – Walking 2.0 and Future Mobility
4 prizes – Walking and the Arts
1 prize – Fashion and Walking Gear
4 prizes – Planning and Design for Liveable Public Spaces

If a prize winner fails to respond within ten (10) days to the e-mail notification of his/her winning, such winning entrant shall be deemed to have forfeited his/her claim to such prize, and stadt wien marketing gmbh as the organiser of Walk21 Vienna shall not have any obligation whatsoever to compensate the winning entrant in any way.

4. ADDITIONAL TERMS

Votes will not be accepted prior to or after the Voting Periods, and only votes for nominees in categories contained on the Website will be accepted. The use of any device to automate a vote is prohibited, including but not limited to software-generated, robotic, programmed, script, macro or other automated votes.

Walk21 Vienna reserves the right at its sole discretion to determine the Walking Visionaries and to disqualify any individual (and remove any votes from that individual) it suspects or finds: (a) to have used a software-generated, robotic, programmed, script, macro or other automated vote; (b) to have tampered with the voting process; (c) to be acting in violation of these Official Voting Rules; or (d) to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Walk21 Vienna reserves the right to remove votes at its sole discretion.
If, for any reason, any aspect of the voting process cannot run as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical or system failures or disruption, force majeure or terrorist attacks, or any other causes beyond the control of Walk21 Vienna which corrupt or affect the administration, security, fairness, integrity or proper conduct of the voting process, or for any reason Walk21 Vienna deems necessary, VMN reserves the right at its sole discretion to cancel, terminate, modify or suspend the voting process and reserves the right to determine the Walking Visionaries at its sole discretion.

You participate in this voting process at your own risk. Walk21 Vienna and any of their respective parent companies, affiliated companies, related companies, sponsors, subsidiaries and advertising agencies, and any entity associated with this voting process (“Released Parties”) are not responsible nor shall not be liable for: (i) difficulty accessing telecom systems; (ii) errors in transmission; (iii) service outage or delays or any problems or technical malfunctions of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of e-mail or players on account of any technical problems or traffic congestion on the Internet or the Website or any combination thereof; (iv) any incomplete, lost, late, delayed, misdirected or garbled votes or failure to receive votes; (v) injury or damage to you or to any other person’s computer or mobile device related to or resulting from participating in, or downloading materials or software, or attempts to participate in or download materials or software related to this voting process or (vi) failures or malfunctions of phones (including wireless phones/handsets), phone lines or telephone systems, cellular equipment towers, telephone systems or wireless services or other communications malfunctions. The Released Parties are not responsible for and shall not be liable for: (i) any condition caused by events beyond the control of the Released Parties that may cause the voting to be disrupted or corrupted; (ii) typographical or other errors in the printing, offering or administration of the Official Voting Rules or (iii) any errors in the announcement of potential winner(s).
The participant assumes all liability for any injury or damages caused or claimed to be caused by his/her participation in the voting opportunity described in these Official Voting Rules, and herewith releases the Released Parties and any party associated with the production or exhibition of the Awards and their respective officers, directors, employees, shareholders, parents, subsidiaries and affiliates from any such claim or liability.

By participating in this voting process, you agree to be bound by these Official Voting Rules. Failure to comply with the Official Voting Rules may result in a voter’s disqualification at the sole discretion of Walk21 Vienna. Walk21 Vienna reserves the right to modify these Official Voting Rules at any time at Walk21 Vienna’s sole discretion.

All interpretations of these Official Voting Rules and the decisions of Walk21 Vienna relating to this voting process are final.

The submitters receiving the highest number of valid votes in each category, and hence eligible for the prizes indicated in (3. PRIZES), as determined by Walk21 Vienna at its sole discretion, will be deemed the winners (“Walking Visionaries”) of this category. In the event of a dispute or tie or if for any other reason Walk21 Vienna deems it necessary or appropriate, Walk21 Vienna reserves the right to make the final determination as to which of the nominees will be declared the winners of the category. Nominees are prohibited from obtaining votes by any fraudulent or inappropriate means, including, without limitation, offering prizes or other inducements to members of the public, as determined by Walk21 Vienna at its sole discretion.

These are the official terms and conditions (the “Official Voting Rules”) for voting for the “Walking Visionaries Awards online voting” (the “Awards”) on www.walk21vienna.com (the “Website”) between 26 May (2PM CET) – 16 June 2015. These Official Voting Rules are incorporated by reference into the Website’s Terms of Use Agreement. The Website and the Awards are owned and operated by stadt wien marketing gmbh on behalf of the City of Vienna (“Walk21 Vienna”).

These terms and conditions and any matters relating hereto are governed by the laws of the Republic of Austria, and the federal courts in Vienna, Austria, shall have jurisdiction regarding any and all relevant disputes.
